DISCLOSURES, TERMS AND CONDITIONS
"NOTICE TO CONSUMER”
Premium Construction & Development Inc. offers a 1-year warranty on all installed labor, unless otherwise specified in the project contract. This warranty covers any defects or issues arising from the workmanship of the Contractor. However, please note that material guarantees from the manufacturer are subject to the specific terms and conditions set forth by each manufacturer. Any alterations or modifications made to the project by the Customer or any other party may void the warranty provided by Premium Construction & Development Inc.
Premium Construction & Development Inc. is not responsible for any driveway damage due to the container placement.
Premium Construction & Development Inc. takes no responsibility for items left in the work area.
Payment for the services rendered by Premium Construction shall be made in full upon completion of the work. Any outstanding balance shall be settled within seven (7) days of invoicing. Failure to make timely payment may result in additional charges, including but not limited to interest and collection fees. All open balances will be charged to credit card on file after (7) days.
It is the customer's responsibility to move any objects, vehicles, or items located within the work area. Premium Construction & Development Inc. will not be held accountable for any damages caused to such items during the construction process. The work area will be left in a broom-clean condition, but the customer may need to perform a final light cleaning or power washing after the completion of the project.
Work shall begin within 14 days of signing contract (or securing required permits). Work is estimated to be finished within 45 days. This estimation is contingent upon multiple factors including but not limited to weather, back order, permits and delays.
Construction Schedule and Delays: Premium Construction will provide an estimated timeline for project completion. However, unforeseen circumstances such as weather conditions, permit delays, or unforeseen site conditions may cause alterations to the schedule. Premium Construction will make reasonable efforts to complete the project within the given timeline, but shall not be held responsible for any delays beyond its control.
Any contractor, subcontractor, or material man who provides home improvement good or services pursuant to your home improvement contract and who is not paid may have a valid legal claim against your property known as a mechanic's lien. Any mechanic's lien filed against your property may be discharged. Payment of the agreed upon price under the home improvement contract prior to filing of a mechanic's lien may invalidate such lien. The owner may contact an attorney to determine his rights to discharge a mechanic's lien.
3-day cancellation notice. You have until midnight of 3rd business day from signing contract to cancel this contract. Cancellation must be in any of these two ways.
1. SEND A SIGNED AND DATED WRITTEN NOTICE OF CANCELLATION BY REGISTERED OR CERTIFIED MAIL, RETURN RECEIPT REQUESTED.
2. PERSONALLY DELIVER A SIGNED AND DATED WRITTEN NOTICE OF CANCELLATION TO our office.(address located at the top of the contract). If you cancel this contract within the three-day period, you are entitled to a full refund of your money. Refunds must be made within 30 days of the contractor's receipt of the cancellation notice.
If installments not made, re-billing fee of 1-1/2% applied to unpaid bills after 30 days. Cancellation fees apply. Balance due day of completion. All work dates and completion times are weather contingent. Price subject to change without notice until accepted by customer.
All escrow funds are held at TD Bank
3.5% Convenience fee applied to all credit card charges unless specifically agreed upon.
The consumer is responsible for the timely payment of the total amount specified in the invoice, including the Permit Fee of $550.00 (if applicable).
Scope of Work: Premium Construction shall provide the consumer with the agreed-upon construction services as outlined in the contract. Any changes or additions to the scope of work must be approved by both parties in writing.
Work Stoppages: In the event of work stoppages caused by factors beyond the control of Premium Construction, such as natural disasters, extreme weather conditions, accidents, or force majeure events, a surcharge may be applicable. The surcharge will cover the additional costs incurred during the period of work stoppage, including but not limited to labor, materials, and equipment. Premium Construction will make all reasonable efforts to minimize any work stoppages and associated surcharges.
Satellite Dish Re-Installation: If the project requires the re-installation of satellite dishes, it shall be the responsibility of the customer to coordinate with their respective service provider. Any additional costs incurred for the re-installation shall be borne by the customer. Premium Construction shall not be liable for any charges related to satellite dish re-installation.
